Summary of the court hearing

ISPs have departments for this stuff, to help the CIA track actual terrorists and shit. I’m sure they’ll be super efficient at finding barfyman who said a fat mans book was “not good”
the more time goes on the less likely the isp can even trace them. even then rick would still lose in court if he found out anyones identity and by that point the sfwa defender of pedos would be into this for 250k large right? gangster talk for hes a beef stew

It's just insane how the judge doesn't question any of this and hasn't from the start.
I'm catching on a bit, and I'm seeing why Judge Ashley is like this.

He's going by the book. His face tells the story - "you guys don't have shit" - but there must be some leniency judges have to adhere to. They can't haphazardly throw cases out, I suppose.

Resto asked for another 90 days, and Ashley basically said "hey, have another 120, I don't have any faith in this anyway" which makes him look generous, but it's a joke. Hell, offering 120 days might be the polite way of saying "I don't wanna see you morons for another four months, now fuck off".

well at this point even if rick were to indentify an innocent john doe, im sure doe's lawyers would argue these extensions were unwarranted and the case will be dismissed.

You're right. He's just there to follow Proper ProTocol. Him waiting for California to decide their side first is common courtesy.

And it's not like we have to wait until January for the next Wisconsin hearing if California tosses the subpoena request Thursday. It won't take place. Resto will give it a week to update Ashley that he's done in Wisconsin and request to refile in the future should they get new info.

the more time goes on the less likely the isp can even trace them.

ISPs in the states don't hold onto IP logs for more than 12-18 months. This lawsuit has been stagnating for 9 months. That's half of the retention time of the ISPs that hold onto logs the longest. This "drawing out the case" shit just makes it impossible to win.

Oh, child. This isn’t about them. Quasi personally knows every single members birth names, I’m sorry you’re so bad at this.

Realistically, if Pat somehow wins on Thursday, the next step would be to get quasi to release the information that they already have again, and then wait another few months to bring it to a judge to sign off on authorization to request information on those IPs. By then, 90% of the ISPs involved will have purged their records of who those IPs were assigned to and they will essentially shrug their shoulders and say “sorry, we don’t have that anymore.”

EVEN IF they had those records, and EVEN IF none of the IPs were anonymous VPN servers that don’t keep logs or Tor, Pat’s lawsuit would now have to enter several new states. This is due to the simple fact that very few, if any Does are located in Wisconsin. He’d have to file new lawsuits with brand new lawyers, with brand new fees for each one, in every state that a Doe resides in. We’re talking a multi-million dollar lawsuit before anyone is even called to court yet. Once they are, he’d somehow have to prove that comments like “not good” cost him his livelihood and caused him debilitating fear in public, which is next to impossible.

Notice all the ‘ifs’ here? There is no realistic scenario in which Pat comes out a winner in this lolsuit.

How much weight will he gain in the process though? Just trying to ask the important questions here.

Exactly. it seems like what happened was they figured the !subpeona! would scare Rahul. He lawyered up because he didn't want to be identified. He knows all the names, he even admitted it in this illegally obtained screenshot. He has all the names and real emails and for the ones he doesn't know he has the ip addresses. Except none of that is true and it seems like the "pretext" argument is exactly what they were doing.

Quasi doesn't have anyone's ips, unless you think he lied in a sworn deposition. They won't even get that much. I know snitches get stitches and all but I doubt Quasi would be committing perjury for any of you. Brinton even admitted this. He says there's no sworn testimony in his original email then quasi submits several signed declarations. Brinton is the equivalent of someone knowing html and calling themselves a tech expert. The way he says "there are no timestamp for the ips", is basically what he'd say to google. As if a private web forum has the same compliance requirements as a publicly traded company. Stick to bootleg bordeaux cases Brinton.

And nothing they wrote on those sites is illegal. Judge Stein himself said the worst review that tried to make Pig look antisemitic did not rise to defamation. Brinton has no case. This is just a witch hunt and money grab.
I don't even understand how you can sue over a reader's interpretation of a book. In To Kill a Mocking Bird, I always interpreted Boo Radley as an allegory for Nazi Germany. Initially everyone thinks Boo is this frightening, insane monster, but by the end of the novel he's revealed to be the hero of the story!
