...while we're on the topic, the SFWA (who some people think are bankrolling Tubby's case) are a 501(c)3 public charity "organized exclusively for charitable, educational, and scientific purposes." (source)
I suggest that this court battle is not about "promoting genre fiction" (the SFWA's supposed purpose), it's about a big fat stupid loudmouth on Twitter. I further suggest that any attempts by the SFWA to loan Rick the money for this case would breach Article II Section 2 of the SFWA's bylaws ("No part of the profits or net earnings of this Corporation shall ever inure to the benefit of any of its Directors, officers, members, employees, or to the benefit of any private individual, except as specifically allowed by a contract for services rendered to the Corporation and agreed to by the Board.") Further, I suspect that such a loan would breach the IRS' "inurement rules" for 501(c)3 charities, as it's clearly for Porky's P-Personal B-Benefit, and could cost them their "tax-free charity" status.
....and if he gets a discount on paying back such a loan and only has to pay back part of it, they're definitely fucked, as that's just handing money to him. I don't think the SFWA will survive for long as a for-profit institution, unless child pornography suddenly becomes legal.
We can apparently check all of this down the track by requesting to see their Form 990 either from them, or the IRS.
