In the ruling the judge(s) found that Trump "did engage in an insurrection on Jan. 6, 2021 'through incitement, and that the First Amendment does not protect Trump's speech'."
The appeals court (maybe Supreme Court) won't look at whether Trump was actually involved in the insurrection, convicted or not, only if the law was properly applied. I don't think the Supreme Court will even hear the case, there's really no need to.

This is almost always the correct answer re: Trump. He lost Colorado bigly in the last election, if he runs he doesn't need it, and there's no way he's parting with more money to fight his way through the Supreme Court over it. It actually helps him, as it plays right into his base's persecution complex. It's just more fodder for the tweeting queers to chew on and ruminate.
