Because, as it appears, they're the ones really funding the suit. Pat didn't just start this and said "money is no object." They are greenlighting this mess every step of the way. It's possible that they could, and maybe when they see Pat's antics during this ordeal they'll decide to attempt to reclaim their grant, but I doubt it.Why wouldn't they?
