The case wasn't useless at all, these things work on every yelper who says the "lasagna sucked and the salad was wilted". They always take down their review and I bet most defend on their own and walk away wholly intact without costs. Resto thought the site owner would just shut down, he'd get 10k from Pat and withdraw the suit as moot. He tried a blanket approach used against reviewers who are individuals vs a forum that really is a free speech issue and an owner who was rich enough to have 17k to risk. Once Quasi replied that should have been their sign to ditch.
Did they even give quasi the option to shut down the site? Judging by the email exchange in the SF quash documents, that wasn't even an option. Resto wanted Quasi's identity. that's it. Once quasi hired a first amendment law firm in SF to quash the subpoena Resto had no plan other than delay. Resto couldn't even appear in the Cali hearings because he was never accepted pro hac vice there like he was in Wisconsin.
